Further to our message of January 31, 2023, we are pleased to inform you that Employment Agreement sample templates for all streams under the Temporary Foreign Worker (TFW) Program are now available online, within the following links:

Note:

For SAWP only, the employment agreement (EA) is not meant to replace or supersede the Contract for employment in Canada of Seasonal Agricultural Workers. The EA is a separate document.
In addition, a Spanish version of the employment agreement is available online for reference purposes only and not for completion or signature. Employers are encouraged to share this information with their workers.

You are welcome to use these templates or develop your own. These templates were designed to lessen administrative burden for employers and support compliance with amendments to the Immigration and Refugee Protection Regulations that came into force on September 26, 2022, and which require employers to:

- draft an employment agreement in either English or French as preferred by the foreign worker;
- include information for employment in the same occupation, with the same wages and working conditions as those set out in the offer of employment; and
- sign and secure signature from the foreign worker, and provide a copy to the worker.

Programme des travailleurs agricoles saisonniers (PTAS)

Remarque :

- Pour le PTAS uniquement, le contrat d’emploi ne vise pas à remplacer ou à supplanter le contrat du PTAS au Canada pour les travailleurs agricoles saisonniers. Le contrat d’emploi est un document distinct.
- En outre, une version espagnole du contrat d’emploi est disponible en ligne à titre de référence uniquement et ne doit pas être complétée ou signée. Les employeurs sont encouragés à partager ces informations avec leurs employés.
Secteur agricole primaire : Volet agricole, volet des postes à bas et haut salaires

Vous pouvez utiliser ces modèles ou encore développer le vôtre. Ces modèles ont été conçus afin d’alléger la charge administrative des employeurs et les aider à se conformer aux modifications du Règlement sur l’immigration et la protection des réfugiés qui sont entrées en vigueur le 26 septembre 2022 et qui exigent que les employeurs :

- rédigent le contrat d’emploi en anglais ou en français, selon la préférence du travailleur étranger;
- incluent les informations relatives à l’emploi dans la même profession, avec le même salaire et les mêmes conditions de travail que ceux énoncés dans l’offre d’emploi;
- signent et obtiennent la signature du travailleur étranger, puis fournissent une copie du contrat d’emploi au travailleur étranger.
